You may be eligible for reimbursement from your school district if you send your child to a boarding school, wilderness program, or other specialty education provider. If a school district can not, did not or will not provide a free appropriate education, they may be out of compliance with federal law and must be held accountable. Does your child exhibit symptoms of drug and alcohol abuse or suffer from depression and anxiety? If so, is the school providing a pathway for your child to receive a free appropriate public education? If not, your child may be eligible to receive their education outside the school district (boarding school) and the school district may be compelled to reimburse the costs associated with a private education.
The Act protects the rights of individuals with disabilities enrolled in programs that receive federal funding – specifically school districts. As parents, you should know these words, “No otherwise qualified individual with a disability in the United States . . . shall, solely by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance…”
Compliance is required. The Act demands school districts provide each qualified person with a disability that is in the school district’s jurisdiction, regardless of the nature or severity of the person’s disability, a free appropriate public education (FAPE).
(i) has a physical or mental impairment which substantially limits one or more major life activities, (ii) has a record of such an impairment, or (iii) is regarded as having such an impairment.”
Regular classes, education in regular classes with the use of related aids and services, or special education and related services in separate classrooms for all or portions of the school day. Special education may include specially designed instruction in classrooms, at home, or in private or public institutions, and may be accompanied by related services such as speech therapy, occupational and physical therapy, psychological counseling, and medical diagnostic services necessary to the child’s education. Boarding school and wilderness therapy may qualify for reimbursement.
